1. Introduction and Acceptance
These Terms of Use ("Terms") govern your access to and use of the Artistry mobile application and website (collectively, the "Service"), operated by Oliver Mather ("we," "us," or "our").
By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
2. Nature of the Service
Artistry is a curation and discovery platform that aggregates original artwork listings from third-party marketplaces (such as Etsy and Artfinder) and independent sellers (via Shopify) ("Third-Party Sellers").
- We are a Directory: We do not own, sell, resell, hold stock of, or manage the inventory displayed on our Service. We act solely as a portal to connect Buyers with Third-Party Sellers.
- No Agency: Artistry is not an agent, employee, or representative of the Third-Party Sellers.
3. Transactions and Liability
- The Contract: When you wish to purchase an item discovered on Artistry, you will be redirected to the Third-Party Seller's website or platform to complete the transaction. The contract for the sale of goods is formed strictly between you (the Buyer) and the Third-Party Seller. We are not a party to this contract.
- No Liability for Goods: We are not responsible for the fulfillment, delivery, quality, safety, authenticity, or legality of the items.
- Returns and Disputes: All queries regarding shipping, cancellations, returns, refunds, or damaged goods must be directed to the Third-Party Seller in accordance with their specific terms and conditions. As a UK consumer, your statutory rights (such as the right to return goods within 14 days under the Consumer Contracts Regulations) lie against the Seller, not Artistry.
4. Content and Accuracy
- Source Data: The product information, images, and prices displayed on Artistry are pulled from third-party sources. While we attempt to provide accurate curation, we cannot guarantee that product descriptions or pricing are error-free or up-to-date in real-time.
- Availability: Product availability is determined by the Third-Party Seller. We are not liable if an item listed on our Service is sold out or removed by the Seller before you can purchase it.
5. Affiliate Disclosure (Financial Relationship)
- How We Are Paid: Artistry participates in various affiliate marketing programs. This means that when you click a link on our Service and make a purchase on a Third-Party Seller's site, we may earn a referral commission.
- Cost to You: This commission is paid by the retailer or seller. It does not increase the price you pay for the artwork.
6. Intellectual Property
- Service Content: The design, code, curatorial selection, and "Artistry" brand assets are owned by Oliver Mather.
- Third-Party Content: All artwork images and descriptions displayed are the intellectual property of their respective creators or rights holders. Artistry displays this content for the purpose of promoting the works and directing traffic to the rights holders, in accordance with affiliate agreements or API usage terms.
7. User Conduct
You agree not to:
- Use any robot, spider, scraper, or other automated means to access the Service for any purpose.
- Attempt to reverse engineer the app software.
- Misuse our Service to knowingly distribute viruses or malicious content.
8. Disclaimers and Limitation of Liability
- "As Is": The Service is provided on an "as is" and "as available" basis. We make no warranties regarding the authenticity or provenance of the artwork displayed, as we rely on the data provided by the Third-Party Seller.
- Limitation: To the fullest extent permitted by applicable law, Oliver Mather (trading as Artistry) shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service or your transactions with Third-Party Sellers.

10. Governing Law
